By accessing or using the FixArt AI platform, website, or any associated software (collectively, the “Platform”), you agree to be bound by these terms. If you do not agree to all of these terms, do not use the Platform. FixArt AI (“we,” “us,” or “our”) provides artificial intelligence-powered tools for image generation, video generation, and media editing. This Agreement is a legal contract between you (“User” or “you”) and FixArt AI.

1. Access to Services and Eligibility

By creating an account, you affirm that you are at least 18 years of age or the age of legal majority in your jurisdiction. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to this Agreement. Regional Restrictions: Due to regulatory compliance and legal restrictions, access to and use of the Platform is strictly prohibited for users located in, residing in, or accessing the services from the People’s Republic of China (specifically including Mainland China and the Hong Kong Special Administrative Region). By using the Platform, you represent and warrant that you are not located in or accessing the service from these restricted regions. We reserve the right to immediately suspend or terminate accounts, and block access (including IP blocking) from these jurisdictions without prior notice or refund. We reserve the right to modify, suspend, or discontinue any part of the FixArt AI services—including specific AI models for image or video generation—at any time without prior notice.

2. User Accounts and Security

To access certain features like high-resolution video generation or advanced editing tools, you must register for an account. You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at support@fixart.ai if you suspect any unauthorized use of your account.

3. Intellectual Property and Content Ownership

3.1 Your Generated Content

Unlike traditional licensing models, FixArt AI does not claim copyright ownership over the images or videos you generate using our Platform (“Generated Content”), provided you have complied with these Terms. Subject to applicable law, you own the rights to your Generated Content and are free to use them for personal or commercial purposes.

3.2 License to FixArt AI

By using the Platform, you grant FixArt AI a non-exclusive, worldwide, royalty-free license to host, copy, display, and use your inputs (text prompts, uploaded images) and Generated Content specifically for the purpose of (i) delivering the service to you, (ii) improving our AI models and algorithms, and (iii) ensuring safety, filtering harmful content, and compliance with our content policies.

3.3 Platform IP

The interface, software code, AI models, logos, and branding of FixArt AI remain our exclusive intellectual property. You may not reverse engineer, decompile, or attempt to extract the source code or underlying weights of our AI models.

4. Acceptable Use Policy and Harmful Content Prohibition

FixArt AI utilizes powerful generative technology and strictly prohibits the generation, editing, or dissemination of harmful content. You agree not to use the Platform, nor attempt to prompt the AI, to generate or output content that:
  • Violates Laws: Breaches any international, federal, or local laws and regulations.
  • Harmful & Dangerous Activities: Provides instructions for creating weapons, explosives, illegal substances, or promotes terrorism, self-harm, and illegal acts.
  • Exploitation & Abuse: Depicts child sexual abuse material (CSAM), pedophilia, or non-consensual sexual content/nudity.
  • Hate & Violence: Promotes violence, hate speech, discrimination, gore, or harassment against individuals or protected groups.
  • Misinformation & Deception: Generates materials intended to spread disinformation, manipulate democratic processes, or deceive the public (e.g., fake news, election interference, scams).
  • Infringement & Deepfakes: Infringes on the intellectual property rights, privacy, or publicity rights of others (e.g., creating “deepfakes” of celebrities, politicians, or private citizens without explicit consent).
  • Malicious Code: Contains or generates malware, viruses, or malicious code.
Bypassing Safety Systems: You are strictly prohibited from attempting to bypass, disable, or circumvent our safety filters, “jailbreak” the AI models, or use adversarial prompts to force the AI to generate prohibited material. If the AI inadvertently outputs harmful content, you must not distribute it and are obligated to delete it. Violation of this section will result in an immediate and permanent ban from FixArt AI, forfeiture of any remaining subscription fees, and potential reporting to law enforcement authorities.

5. Subscription and Billing

FixArt AI offers both free and paid subscription tiers. By selecting a paid plan, you agree to pay the fees indicated at the time of purchase.
  • Renewals: Subscriptions automatically renew at the end of each billing cycle unless canceled at least 24 hours prior to the renewal date.
  • Cancellations: You may cancel your subscription through your account settings. Access to paid features will continue until the end of the current billing period.
  • Refunds: Generally, payments are non-refundable. Exceptions are made at our sole discretion or as required by applicable consumer protection laws.

6. Limitations of AI Technology

You acknowledge that artificial intelligence is an evolving technology. FixArt AI makes no warranties regarding the accuracy, quality, or uniqueness of the Generated Content.
  • Hallucinations: The AI may generate artifacts, errors, or physically impossible visuals.
  • Similarity: Due to the nature of generative models, similar prompts may yield similar results for different users.
  • Suitability: You are solely responsible for determining if the Generated Content is suitable for your intended purpose and compliant with Section 4.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” FIXART AI DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FIXART AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE AI IMAGE GENERATOR, VIDEO GENERATOR, OR EDITING TOOLS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO FIXART AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Third-Party Links and Resources

Our Platform may contain links to third-party websites or services that are not owned or controlled by FixArt AI. We assume no responsibility for the content, privacy policies, or practices of any third-party websites.

10. Modifications to Terms

We may revise these Terms from time to time. If a revision is material, we will try to provide at least 30 days’ notice via email or a website notification. By continuing to access the Platform after those revisions become effective, you agree to be bound by the revised terms.
